This Refund Policy is part of the Agreement titled “Terms and Conditions of Use Agreement”. Subscribers agree to read that Agreement. We expect that SonicTransfer Pro will be available 95% or more of the time (after fourteen months of operation, SonicTransfer.com has been available 99% of the time). However, this Refund Policy is designed in case the Site is off-line for an extended period of time. Just to be safe, we advise subscribers to print the entire site immediately upon the start of your subscription. Before ordering SonicTransfer Premium, you should carefully review the Premium Contents, which are available on SonicTransfer.com.
Due to the nature of the subscription and the fact that the material can be printed at any time, except for during the first 5 days of a subscription, refunds will only be provided if the entire SonicTransfer Premium site (the “Site”) is out of service (i.e., “off-line”) and not available to any subscribers due to circumstances within our control (acts of God, natural or manmade disasters and similar events are not within our control) (situations qualifying for a refund are hereinafter referred to as those where the Site is “Avoidably Unavailable”), and then only upon request and according to the following policy:
A subscriber can receive a full refund at any time during the first 5 days of the subscription term with no questions asked.
A subscriber shall be eligible for a refund if, after the first 5 days of the subscription term, the Site is Avoidably Unavailable more than 10% of the remainder of the subscription term. In this case, the refund shall be calculated from the date the refund is requested according to the same formula described in no. 1 above, however the refund shall be the resulting amount less $9.95 (US), which is the estimated value of the first month’s subscription.
